We may add additional Sites from time to time as we expand our beauty offerings and these Terms will govern those new Sites when added. You may be accessing our Sites from a computer or mobile phone device (through an iPhone application, for example) and these Terms govern your use of our Sites and your conduct, regardless of the means of access.

Your access to and use our Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Site you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Site.

1. PURCHASES

If you wish to purchase any product or service made available through the Site or one of our retail store in the U.S. (New York) (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, email address, nickname, skin tone and type, hair color and type, eye color, Color IQ, age range.

This information may be used at Beleza Natural ‘s sole discretion, according to our Privacy Policy.

By giving this information to Beleza Natural, you represent and warrant that:

• — You are solely responsible for maintaining the confidentiality and security of your account including username and password.
• — You are at least 13 years old and, if you are a minor, that you have obtained the consent of your parent or legal guardian to use this Site and their agreement to these Terms.
• — You agree that Beleza Natural does not have any responsibility if you lose or share access to your device.
• — You are responsible for all activities that occur under your account or password.
• — You understand that we reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.

2. PRODUCT AND SERVICE INFORMATION

Beleza Natural products and services displayed on the Sites may be available in our Beleza Natural retail stores in the U.S. (New York) and certain foreign markets (as Brazil). All prices displayed are quoted in U.S. Dollars and are valid and effective only in the U.S.

In reference to Service Prices, the prices listed include gratuities for the Beleza Natural´s team members who service you.

In our Payments & Payment Policy, we accept all major credit and debit cards, gift cards, money orders and of course cash. No checks accepted.

All material and information presented by Beleza Natural is intended to be used for personal, educational or informational purposes only. The statements and products and services sold through Beleza Natural are not intended to diagnose, treat, cure or prevent any disease. If any minor uses any services or product from Beleza Natural it should be only after the legal or parental guardian has discussed the product and service with the minor’s doctor.

All products and services should be used strictly in accordance with their instructions, precautions and guidelines. You should always check the ingredients for products and services to avoid potential allergic reactions. The use of our Site is not meant to serve as a substitute for professional medical advice: these Sites are solely stores for specialty beauty products. Please consult with your own physician or health care practitioner regarding the use of any services, products or information received from the Sites before using or relying on them. Beleza Natural does not give or intend to give any answers to medical related questions and these Sites do not replace any medical professional or medical resource.

The BN’s pictures, labels and marketing materials shown are for illustration purpose only. The result may vary due to each type of hair. Each person is unique and each hair has its own unique characteristics. We cannot guarantee the same result for different characteristics.

3. APPOINTMENTS

— Consultation Appointments: We do not charge for a consultation! We do this because we are so confident you will be impressed with our philosophy that you will decide to try our services that day or book an appointment for a later date. We ask that you book an appointment for your initial consultation, if possible. However, we can perform the initial consultation without an appointment, but you have to be aware that you may have to wait until one of our team members is available. The Consultation is a session to exchange information. After we gather your information and inform you of what service Options are available to you, you will make the Final decision about the service(s) you will be receiving on the day of your visit. After your consultation / first visit, you may need time to decide on the service that’s perfect for your natural curly hair needs.

— Appointment Booking and Deposit: You can book an appointment online at http://scheduler.belezanatural.com or by calling (917) 265-8959.

— Refund/Our Commitment to Your Satisfaction: We are committed to your healthy hair and satisfaction, quality products/services etc. Our team of professionals are trained, educated, experienced and will provide you with the best hair care service possible. However, if you are not satisfied with the results of any salon service, please let us know up to one week after the service is done. We offer a free consultation with our manager and, if necessary, a one-time adjustment at no additional charge.

— Appointment Cancellations: Your appointment is very important to us as it is reserved especially for you. We will send out appointment reminders via email and/or text two days in advance of all appointments. You may email, text or call to (917)265-8959 to confirm, reschedule or cancel an appointment. We understand that scheduled adjustments are necessary; therefore we have in place an 48-hour cancellation policy for all appointment cancelations including consultations. If we receive no cancellation from you 48-hours in advance of your appointment we charge ten per cent (10%) of the service price. We ask that all clients arrive 15-minutes before their appointment. All appointments not honored within 15 minutes of your appointment time with no notification of a late arrival may have to be canceled, and deposits may be forfeited.

4. CONTENT THAT YOU SUBMIT

Our Site also allows you to post, link, share or otherwise make available certain information, text, videos, or other materials (”Content”). You are responsible for all content that you upload, post, email or otherwise transmit via or to the Sites or Third Party Sites, through the Subscription or otherwise. None of the Content that you submit shall be subject to any obligation of confidence on the part of Beleza Natural, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees. Under no circumstances will Beleza Natural be liable in any way for any Content, including, but not limited to, for (1) any errors or omissions in any Content; or (2) any loss or damage (including, without limitation, personal injury or property damage) of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via or to the Sites or Third Party Sites.

You represent and warrant that the Content you supply does not violate these Terms and will not cause injury to any person or entity.

You grant to Beleza Natural a royalty-free, perpetual, irrevocable, worldwide, unlimited, nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display (publicly or otherwise) any Content that you make available, in any media or medium, and in any form, format, or forum now known or hereafter developed. You further agree that Beleza Natural is free to use any Ideas for any purpose. Beleza Natural may sublicense its rights in Content and Ideas through multiple tiers of sublicenses. Beleza Natural is, and will be, under no obligation (1) to maintain any Content or Idea in confidence; (2) to pay any compensation for any Content or Idea; or (3) to respond to any Content or Idea. You grant to Beleza Natural the right to use any name associated with any Content or Idea that you make available to Beleza Natural, although Beleza Natural has no obligation to exercise such right, or to otherwise provide any attribution for any Content or Idea.

Beleza Natural will have the right to remove any Content that Beleza Natural deems, in its sole discretion, to violate any provision of these Terms.

Our Site may contain links to third party sites where we post content or invite your feedback, such as Facebook, Twitter, Instagram, Youtube (“Third Party Sites”) or may provide content of third parties (“Third Party Content”). Those Third Party Sites are not owned or controlled by Beleza Natural, and these Terms do not apply to those companies that Beleza Natural does not own or control, or to the actions of people that Beleza Natural does not employ or manage. Belezanatural.com and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of Beleza Natural and may not be used in connection with any product or service that is not offered by Beleza Natural in any manner that is likely to cause confusion among customers. All other trademarks, product names and company names or logos eventually cited in our Site are the property of their respective owners.

9. INTELLECTUAL PROPERTY

The Beleza Natural Sites and all Materials, and all copyrights, trademarks, trade dress, and other intellectual property rights there (collectively, the “IP”) are owned or controlled by or licensed to Beleza Natural, and are protected by U.S. and international trademark, copyright, and other intellectual property laws.

No license, right, title, or interest in the Beleza Natural Sites or any Materials is transferred to you as a result of your use of the Beleza Natural Sites or your accessing, viewing, downloading, or printing of the Materials. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell, or participate in any sale of or exploit in any way, in whole or in part, any of the Materials or the Beleza Natural Sites. The compilation of the Beleza Natural Sites and Materials is the exclusive property of Beleza Natural and is also protected by U.S. and international copyright laws.

Beleza Natural reserves the right, at its sole discretion, to replace or modify any of the terms and conditions contained in the Terms, from time to time at any time, without notice. If Beleza Natural decides to change these Terms and post a new version on the Sites, Beleza Natural will update the date set forth above. Any changes or modifications to these Terms will be effective upon posting of the revisions. YOUR CONTINUED USE OF THE SITES FOLLOWING POSTING OF ANY CHANGES OR MODIFICATIONS CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES OR MODIFICATIONS AND IF YOU DO NOT AGREE WITH THESE CHANGES OR MODIFICATIONS, YOU MUST IMMEDIATELY CEASE USING THE SITES.

Beleza Natural shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

13. ENTIRE AGREEMENT

These Terms, including any legal notices and disclaimers contained on this Site, constitute the entire agreement between Beleza Natural and you in relation to your use of this Site, and supersede all prior agreements and understandings with respect to the same.

14. GOVERNING LAW & JURISDICTION.

These Terms will be governed by and construed in accordance with the laws of the State of New York, and you submit to the non-exclusive jurisdiction of the state and federal courts located in State of New York the resolution of any disputes.
